How to Cite
Abstract
This article aims to investigate whether judicial protection is effective as the fundamental rights of personality of indigenous peoples in Brazil. It is used as a data source for research the decision rendered by the Supreme Court in the popular action indigenous land demarcation of Raposa Serra do Sol, since this judgment establishes constitutional safeguards and parameters for future action. Finally, the article reaffirms the constitutional legality and the imperative nature of judicial protection as the personality rights of indigenous peoples.
