Redefinition of fiduciary alienation: the auction investor as an agent of legal and social solutions

Abstract

This paper analyzes, from a legal and economic perspective, the opportunities arising from extrajudicial property auctions governed by Law No. 9.514/1997, focusing on public servants who wish to invest ethically and sustainably. A qualitative methodology is adopted, based on bibliographic and documentary review, using Jurich (2025) as the main reference, complemented by Lopes (2023), Rocha (2021), Valderrama (2021) and Marder (2024). The study is divided into three chapters: the first examines the legal framework of fiduciary alienation and its risks; the second discusses the economic feasibility and ethical aspects of investment by public servants; and the third presents practical guidelines for risk mitigation and the use of technology, highlighting hyperautomation as a driver of efficiency and compliance. The study concludes that, under proper legal and ethical compliance, extrajudicial auctions represent a legitimate opportunity for income generation, asset appreciation and responsible time management by public servants. Future studies are suggested on automated due diligence tools and ethical frameworks for public-sector investment.
