Abstract
Objective: This article examines the Incident of Repetitive Demand Resolution (IRDR) and its governance through the internal regulations of the Courts of Justice, aiming for procedural implementation.
Method: A hypothetical-deductive method was employed, complemented by a literature review research, serving as a medium to present a reflective critique on the issue.
Relevance: In light of these precepts, it is inconceivable that the realm of internal regulation encompasses only the themes expressly mentioned by the Code. It is possible to address the gaps left by procedural law. The postulate of constitutional reserve for internal regulations demands the assessment of normative content within the tribunals' own competency.
Results: The Code has provided contours to the procedure, delineating the necessary actions for the flow of the IRDR. It is incumbent upon the courts to better structure the definition, organization, and direction of the internal judicial tasks. Transparency and the existence of a cooperative process highlight the utility of standardizing actions and steps to be adopted within the court, providing prior knowledge to the involved parties regarding the itinerary.
